How did the Indus Waters Treaty (1960) affect water distribution and relations between Pakistan and India?

Introduction
The Indus Waters Treaty was signed in 1960 after nine years of negotiations supported by the World Bank. It replaced uncertainty over an interconnected river system with clear legal rules. India received primary use of the Ravi, Beas and Sutlej, while Pakistan received primary use of the Indus, Jhelum and Chenab, subject to limited Indian uses allowed by the Treaty.
For Pakistan, this created essential security for an agriculture system built around the western rivers. For both states, it created a channel that continued to function even during war. Its record is therefore impressive, but incomplete. The Treaty divides water more effectively than it encourages joint management, and it was not designed for today's climate and environmental pressures.
How the Treaty distributed water
The eastern rivers went mainly to India
After a transition period, India gained unrestricted use of the Ravi, Beas and Sutlej. Pakistan had previously depended on some canals fed by these rivers, so replacement works were necessary.
The western rivers went mainly to Pakistan
The Indus, Jhelum and Chenab were reserved largely for Pakistan. India retained limited rights for domestic use, specified irrigation, non-consumptive purposes and run-of-river hydropower that meets detailed design conditions.
Pakistan rebuilt its irrigation network
International financing supported link canals, barrages and major reservoirs, including Mangla and Tarbela. These works transferred water from the western rivers to areas that had depended on eastern tributaries. The settlement thus gave Pakistan legal certainty and the infrastructure needed to use its share.
How the Treaty manages disputes
The Permanent Indus Commission keeps contact open
Each country appoints a commissioner. The Commission exchanges data, inspects works and tries to settle routine questions. This technical contact has often survived when normal diplomacy was suspended.
The settlement procedure is graded
Routine questions first go to the commissioners. Certain technical differences may go to a Neutral Expert, while legal disputes may be heard by a Court of Arbitration. The World Bank performs limited procedural duties, such as making specified appointments; it is not a general guarantor of river flows.
Effect on development and bilateral relations
The Treaty gave Pakistan predictable access to the western rivers and made large-scale irrigation and hydropower planning possible. India received clear rights over the eastern rivers and defined room to develop power projects on western tributaries.
Diplomatically, the greatest achievement is survival. The Treaty continued through the wars of 1965 and 1971, the Kargil conflict and repeated crises. It proved that Pakistan and India can follow binding rules when rights, data and procedures are clear. It also prevents every disagreement over a dam from becoming an immediate political confrontation.
However, it has managed relations rather than transformed them. Pakistan worries that the design and combined effect of Indian projects could affect the timing of downstream flows. India argues that Pakistan objects to projects permitted by the Treaty. Disputes over Baglihar, Kishenganga and Ratle show that the legal system is useful, but they also show how little trust exists outside it.
Present weaknesses
The Treaty divides a basin instead of managing it together
It says little about groundwater, water quality, sediment, environmental flows or the health of the Indus Delta. Each side manages its allocation largely on its own.
Climate change was not central to the 1960 bargain
Glacial change, irregular monsoons, floods and droughts now make data-sharing and joint planning more important. The Treaty contains no full basin-wide climate framework.
Pakistan's domestic inefficiency increases vulnerability
Canal losses, weak groundwater regulation, poor water pricing and water-intensive crops cannot be blamed on India. External diplomacy will remain weaker if Pakistan does not manage its own share responsibly.
Way forward
The legal core of the Treaty should be preserved. Early project data, regular inspections and respect for dispute procedures can reduce avoidable suspicion. Supplementary agreements can cover flood warnings, glacier monitoring, drought planning, water quality and environmental flows without reopening the basic river allocation.
Pakistan must also modernise canals, regulate groundwater, improve crop zoning and make interprovincial distribution more transparent. Better domestic governance will strengthen its position in every external negotiation.
Conclusion
The Indus Waters Treaty turned a dangerous legacy of Partition into a predictable distribution of water. It protected Pakistan's main river supplies and preserved limited cooperation with India through decades of conflict. Its weakness is that it manages division better than shared risk. The best course is to defend its legal foundation, widen technical cooperation for climate change and improve water governance within Pakistan.
